*** PLEASE READ THE FOLLOWING INSTRUCTIONS PERTAINING TO PAPERWORK ***

PETITIONS, WAIVERS/ANSWERS ONLY, ARE FILED WITH THE DISTRICT CLERKS OFFICE. ALL OTHER PAPERWORK HAS TO BE DROPPED OFF IN A SECURE DROPBOX IN THE COURTHOUSE BASEMENT BETWEEN 8:00 A.M. - 5:00 P.M. M-F (EXCLUDING COUNTY HOLIDAYS) OR, YOU MAY SCAN AND EMAIL YOUR DOCUMENTS TO THE PRO SE CLINIC EMAIL AS A PDF ATTACHMENT ONLY. WE CANNOT ACCEPT DOCUMENTS IN ANY OTHER FORMAT.

IF YOU CHOOSE TO DROP OFF YOUR PAPERWORK IN THE COURTHOUSE BASEMENT, DO NOT DROP OFF YOUR ONLY COPY OF THE DOCUMENTS. PLEASE MAKE A COPY AND DROP OFF THE ORIGINAL. IT MIGHT BE POSSIBLE THAT CHANGES WILL NEED TO BE MADE TO THE DOCUMENTS AND, IT WILL CAUSE YOU TO HAVE TO MAKE EXTRA TRIPS IF YOU HAVE TO COME BACK AND PICK UP YOUR PAPERWORK TO MAKE THOSE CORRECTIONS.

DO NOT MAIL DOCUMENTS TO THE COURTHOUSE. THE COORDINATOR'S MAIN OFFICE IS NOT IN THE COURTHOUSE AND THE COORDINATOR DOES NOT HAVE A MAILING ADDRESS. YOUR PAPERWORK IS LIKELY TO BE LOST IF YOU MAIL IT.

IF YOU CHOOSE TO SCAN DOCUMENTS, THE PREFERRED METHOD IS TO USE A DESKTOP SCANNER. IF YOU DON'T HAVE ACCESS TO ONE, YOU MAY USE THE ADOBE SCAN APP - FOUND HERE: Adobe Scan: PDF Scanner, or GENIUS SCAN APP. WE CANNOT ACCEPT DOCUMENTS SCANNED THROUGH ANY OTHER TYPE OF SCANNER APP OR PHOTOS. KEEP IN MIND, ANY DOCUMENTS FILED WITH THE COURT ARE MADE PART OF THE PERMANENT RECORD AND SHOULD BE CLEAN, PROFESSIONAL COPIES.

A STATEMENT OF EVIDENCE HAS TO BE FILLED OUT AND SUBMITTED WITH ALL DIVORCE CASES. DO NOT SUBMIT THE STATEMENT OF EVIDENCE FOUND ON THE TEXAS LAW HELP WEBSITE, IT WILL BE REJECTED. ONLY USE THE STATEMENT OF EVIDENCE FOUND UNDER IMPORTANT LINKS/FORMS AT THE BOTTOM OF THIS WEBPAGE.

WHEN MEETING WITH THE PRO SE CLINIC COORDINATOR, PLEASE TAKE GOOD NOTES AND FOLLOW THE INSTRUCTIONS GIVEN. WHEN BEING TOLD TO USE THE FORMS ON THIS WEBPAGE THE REASON IS TO SAVE YOU TIME AND KEEP YOU FROM HAVING TO REDO FORMS. TEXAS LAW HELP IS A WONDERFUL RESOURCE HOWEVER, WHEN THEY UPDATE THEIR FORMS, THEY DON'T REMOVE THE OLD ONES FROM THEIR WEBSITE. IF YOU CHOOSE TO GO TO THEIR WEBSITE FOR YOUR FORMS AND THEY AREN'T THE CURRENT VERSION, WE WILL INSTRUCT YOU TO FILL OUT A NEW ONE. SAVE YOURSELF THE TROUBLE OF REWORK.

***WAIVERS OR ANSWERS CANNOT BE FILED UNTIL 24 HOURS AFTER THE FILING OF THE ORIGINAL PETITION. THE DATE OF SIGNATURE ALSO HAS TO BE AT LEAST ONE DAY AFTER THE FILING DATE OF THE PETITION.***

***MAKE SURE ALL DOCUMENTS ARE SIGNED BEFORE SENDING THEM TO THE PRO SE CLINIC.***

    Reason for Inquiry:

  • Q: I have filed for an uncontested divorce. There are no minor children and parties agree on division of property. What forms do I need to complete next?

A: Respondent needs to file either a Waiver of Service OR, Respondent's Original Answer. Petitioner needs to complete a Statement of Evidence (found under important links on this page), Information on Suit (BVS form, found under important links on this page), and a Final Decree of Divorce (found on texaslawhelp.org and under important links on this page). The Final Decree of Divorce has to be signed by both parties. If unable to locate the Respondent, make an appointment to see the Pro Se Clinic Coordinator for further instructions.

Q: Does the Respondent have to file a Waiver of Service and Respondent's Original Answer?

A: No. Respondent only has to file one of these forms. The main difference is, the Waiver of Service requires a notary to witness the signature. The Original Answer does NOT require a notary. Respondent can also provide the form to the Petitioner to file on their behalf.

Q: What happens after I have turned in all of the required paperwork?

A: Once your 60 day waiting period has expired, our Pro Se Clinic Attorney will review your paperwork. As long as everything is accurate, your file will go to our Judge for signature to finalize your case. A hearing before the Judge is not required in most cases.
